WHEREAS Photographer is in the business of providing professional photographic service and products (“Coverage”), AND Client is desirous of engaging Photographer to provide such Coverage; NOW  THEREFORE for good and valuable consideration (Prints) received the parties hereto agree as follows:     

1. Photographer will provide Coverage of the marriage ceremony of the Client on:

2. Client will pay to Photographer a total price of $____________ on the following terms:     

a. a deposit of $________ upon execution of this agreement; and     

b. the balance, $________, on the  Wedding Day upon completion of photography.     

3. Photographer shall be the exclusive still photographer for Client’s wedding. (Others may be permitted to photograph only at  Photographer’s discretion.)       

4. Photographer will use only quality professional archival materials, however, Photographer does not guarantee that all colors will be reproduced with absolute accuracy in Photographer’s images. Color permanency will depend on the lighting and storage of the photographs by Client, and while they will provide many years of rich color, no warranty by Photographer is implied.     

5. It is expressly agreed that all rights to exclusive use and ownership, including copyright, of negatives, digitally- or electronically-produced images, or any material produced by Photographer and any reproductions therefrom are reserved by Photographer for Photographer’s benefit, whether for display, publicity or otherwise. These rights are negotiable. If the reproduction rights are purchased the rights are shared equally with Positive Image Photography.

6. In the event that Photographer is unable to provide Coverage, Positive Image Photography will make its best efforts to secure the services of an alternate qualified photographer, however the liability of Photographer in any event shall be limited to the refund of the amount  paid.     

7. Client may cancel this contract one-month (30 days) prior to the Wedding Day by written notice to Positive Image Photography for the return of all deposits. Canceling this contract less than 30 days prior to the wedding day, the Client thereby forfeits all deposits paid.

8. Client will send a check with this contract for at least half of the wedding package and the full price of the extras (excluding travel costs) to hold your day. The remaining balance is due 14 days prior to the event. Make checks payable to "Positive Image Photography."

IN WITNESS WHEREOF THE PARTIES HAVE EXECUTED THIS AGREEMENT AS OF THE DATE  FIRST ABOVE
